Terms of Service & Privacy Policy

By accessing, using, or playing Eggscape (the "Game"), whether through the web application, mobile application, or any associated services, you ("User," "you") agree to be bound by these Terms of Service ("Terms") and the Privacy Policy below. If you do not agree, do not use the Game.
These Terms constitute a legally binding agreement between you and Eggscape ("we," "us," "our"). We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.
You must be at least 13 years of age to use the Game. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have parental or guardian consent.
By connecting a Solana wallet and engaging in token-related features (depositing $SKR, earning $EGGSCAPE, claiming tokens), you represent that you are of legal age in your jurisdiction to engage in digital asset transactions.
3.1 Credits: In-game credits are obtained by depositing $SKR tokens to the designated treasury wallet. Credits are non-refundable, non-transferable, and hold no monetary value outside the Game. Credits are consumed when starting or continuing paid game sessions.
3.2 $EGGSCAPE Tokens: $EGGSCAPE tokens earned during paid gameplay are tracked in your account and may be claimed to your connected Solana wallet. Claims must be made in full (no partial claims). Token values are determined by open market conditions and we make no guarantees regarding token value.
3.3 No Refunds: All $SKR deposits, credit purchases, and credit expenditures are final. We do not offer refunds for credits used, lost connections, or game sessions that end prematurely due to technical issues.
3.4 Transaction Finality: All blockchain transactions (deposits, claims) are processed on the Solana network and are irreversible once confirmed. We are not responsible for transactions sent to incorrect addresses or failed due to network conditions.

The in-game global chat is provided for community interaction. Messages are publicly visible to all authenticated users. You are solely responsible for the content of your messages.
We reserve the right to moderate, remove, or restrict chat access for violations of these Terms without prior notice. Chat messages are stored with your wallet address (truncated for display) and a timestamp.
Zero Tolerance for Illegal Content: Any user who posts, shares, links to, or distributes child sexual abuse material (CSAM) or any content depicting the sexual exploitation of minors will be immediately and permanently banned. All associated data, wallet addresses, and activity logs will be preserved and reported to the National Center for Missing & Exploited Children (NCMEC) and/or relevant law enforcement authorities. Users who post CSAM forfeit all rights to privacy under these Terms. See Section 12 of the Privacy Policy for details.
You are solely responsible for the security of your Solana wallet, private keys, and seed phrases. We never request, store, or have access to your private keys.
Authentication is performed via a one-time cryptographic signature when connecting your wallet. This generates a session token for seamless gameplay. You should disconnect your wallet when using shared devices.
All game assets, code, artwork, music, sound effects, and branding are the property of Eggscape and its creators. You may not reproduce, distribute, modify, or create derivative works without explicit written permission.
Your use of the Game grants you a limited, non-exclusive, non-transferable, revocable license to play the Game for personal, non-commercial purposes.
8.1 The Game is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
8.2 We do not guarantee uninterrupted, error-free, or secure operation of the Game or its blockchain interactions. Network congestion, smart contract bugs, or third-party service failures may affect gameplay and token operations.
8.3 To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of tokens, credits, data, or profits arising from your use of the Game.
8.4 Our total liability for any claim shall not exceed the value of $SKR tokens you deposited in the 30 days preceding the claim.
You agree to indemnify and hold harmless Eggscape, its creators, operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Game, violation of these Terms, or infringement of any rights of a third party.
We may suspend or terminate your access to the Game at any time, with or without cause, including for violation of these Terms. Upon termination, any unclaimed $EGGSCAPE tokens may be forfeited if the account was terminated for abuse or fraud.
You may stop using the Game at any time. Unclaimed tokens remain claimable unless the account was terminated for Terms violations.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Game shall first be attempted to be resolved through good-faith negotiation.
If negotiation fails, disputes shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class-action lawsuits or class-wide arbitration.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
We do not collect, use, transmit, sell, or share any personal data. Eggscape is designed to operate with minimal data. We do not require email addresses, real names, phone numbers, physical addresses, or any personally identifiable information (PII) to use the Game.
Your Solana wallet public address is the only identifier used, and it is not linked to any personal identity by us.
The following non-personal data is stored to operate the Game:
This data is stored in Google Firebase (Firestore) with security rules that prevent unauthorized access.
Analytics are optional and only activated if you interact with the chat feature. If you only play the game and never open or use chat, no analytics data is collected whatsoever.
When activated, we use Firebase Analytics which collects only generic, anonymized, aggregate data such as:
No personal data, wallet addresses, game scores, or financial information is included in analytics. Analytics data cannot be used to identify individual users.
We explicitly do NOT collect:
We do not sell, rent, trade, or otherwise provide your data to any third party. Period.
We do not share data with advertisers, data brokers, marketing companies, social media platforms, or any commercial entity.
The only third-party services that process data as part of Game operation are:
We will not voluntarily provide any user data to any government, law enforcement agency, intelligence service, or any other governmental body.
We will only disclose user data if ALL of the following conditions are met:
We will notify affected users of any data disclosure unless legally prohibited from doing so (e.g., under a gag order), and we will challenge gag orders where legally permissible.
Informal requests, subpoenas without judicial oversight, national security letters, and other non-judicial demands will be refused.
Game data (scores, credits, token balances) is retained as long as the Game is operational. Chat messages are stored indefinitely but may be pruned to the most recent messages for performance.
If you wish to have your data deleted, contact us. We will remove all Firestore data associated with your wallet address, subject to legal retention requirements. Blockchain transactions cannot be deleted as they are part of the permanent public ledger.

The Game is not directed at children under 13. We do not knowingly collect data from children under 13. If you believe a child under 13 has used the Game, please contact us so we can take appropriate action.
Data is processed and stored on servers that may be located outside your country. By using the Game, you consent to this transfer. We aim to comply with applicable data protection laws including GDPR (for EU users) and CCPA (for California residents). Since we collect no personal data, most data protection obligations are inherently satisfied.
Eggscape maintains an absolute zero-tolerance policy regarding child sexual abuse material.
Any user who posts, shares, transmits, links to, or distributes CSAM or any content that depicts, promotes, or facilitates the sexual exploitation of minors through the Game's chat, or any other feature:
This policy exists to protect children and is non-negotiable. We actively cooperate with law enforcement to combat child exploitation.
We may update this Privacy Policy from time to time. Material changes will be communicated through the Game. Continued use after changes constitutes acceptance of the updated policy.
