End-User License Agreement (EULA)

Eggscape ("we," "us," "our") grants you a limited, non-exclusive, non-transferable, revocable license to access and use Eggscape (the "Game") on your personal device(s) solely for personal, non-commercial entertainment purposes, subject to the terms of this Agreement.
This license does not grant you any ownership interest in the Game or its content. All rights not expressly granted herein are reserved by Eggscape and its creators.
You may NOT:
In-game credits and $EGGSCAPE tokens earned through gameplay are subject to the terms described in the Terms of Service. Your license to use the Game does not constitute ownership of any digital assets, virtual items, or tokens. We reserve the right to modify, suspend, or discontinue any in-game economy features at any time.
$EGGSCAPE tokens, once claimed to your Solana wallet, are governed by the Solana blockchain and are no longer under the direct control of this license. However, the methods by which tokens are earned within the Game remain subject to this Agreement.
The Game may incorporate open-source software components, each of which is licensed under its respective open-source license. Nothing in this Agreement limits your rights under, or grants you rights that supersede, the terms of any applicable open-source license. A list of open-source components and their licenses is available upon request.
We may release updates, patches, or modifications to the Game at any time. Such updates may be required for continued use and may modify, add, or remove features. Your continued use of the Game after updates constitutes acceptance of the modified Game under this license.
We are under no obligation to provide updates, support, or maintenance for the Game.
This license is effective until terminated. It will terminate automatically if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Game and destroy any copies in your possession.
We may also terminate or suspend this license at our sole discretion, with or without cause, at any time. Sections 2, 7, 8, and 9 survive termination.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EGGSCAPE, ITS CREATORS, OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, TOKENS, CREDITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE GAME, REGARDLESS OF THE THEORY OF LIABILITY.
This Agreement shall be governed by and construed in accordance with applicable law. Any disputes arising under this Agreement shall be resolved in accordance with the dispute resolution provisions in the Terms of Service.
This Agreement, together with the Terms of Service and Copyright Notice, constitutes the entire agreement between you and Eggscape regarding the use of the Game and supersedes all prior agreements and understandings.
